USCPA Participant Waiver

Required for all USCPA event participants

Waiver, Release of Liability & Assumption of Risk

1. REPRESENTATIONS, WARRANTIES & ASSUMPTIONS OF RISK

Participant acknowledges that canopy piloting competition is an inherently dangerous activity involving significant risks of serious bodily injury and death. These risks include but are not limited to: equipment malfunction, operator error, weather conditions, structural failure, collision with objects or other participants, landing hazards, competition course obstacles, water hazards, and risks inherent to high-performance canopy piloting competition. Participant voluntarily assumes all risks associated with participation, whether known or unknown, including the risk of permanent disability or death.

2. EXEMPTION AND RELEASE FROM LIABILITY

Participant, on behalf of themselves, their heirs, executors, administrators, and assigns, hereby releases, waives, discharges, and covenants not to sue United States Canopy Piloting Association (USCPA), its officers, directors, board members, employees, agents, event organizers, judges, volunteers, sponsors, advertisers, and all affiliated organizations, dropzone operators, landowners, and aircraft operators (collectively, the "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by Participant, whether caused by the negligence of the Released Parties or otherwise, while participating in canopy piloting competition or while in, on, or around the premises.

3. COVENANT NOT TO SUE

Participant agrees they will not sue or otherwise institute or assert any claim, demand, or action against the Released Parties for any injury, damage, or loss arising from participation in canopy piloting competition. This covenant not to sue is binding on Participant, their heirs, executors, administrators, and assigns.

4. INDEMNITY AGAINST CLAIMS

Participant agrees to indemnify, hold harmless, and defend the Released Parties from and against any and all claims, damages, losses, suits, judgments, costs, or expenses (including attorney’s fees) arising out of or in connection with Participant’s participation in canopy piloting competition, including but not limited to claims brought by third parties.

5. VALIDITY OF WAIVER

Participant acknowledges that this waiver is intended to be as broad and inclusive as permitted by applicable law. If any portion of this waiver is held invalid, it is agreed that the balance shall continue in full legal force and effect.

6. MEDICAL REPRESENTATIONS

Participant represents that they are in good physical health, have no medical conditions that would impair their ability to participate safely in canopy piloting competition, and have not been advised by a medical professional to refrain from participation. Participant assumes full responsibility for any medical condition that may affect their safety during participation.

7. APPLICABLE LAW & VENUE

This waiver shall be governed by the laws of the State of Florida. Any legal proceedings arising out of this waiver shall be brought exclusively in courts located in Volusia County, Florida.

8. SEVERABILITY / MULTIPLE WAIVERS

If any provision of this waiver is found to be unenforceable, the remaining provisions shall remain in full force and effect. Execution of this waiver does not waive the requirement to sign additional waivers that may be required by specific venues, event organizers, or aircraft operators.

9. CONTINUATION OF OBLIGATIONS

The terms and conditions of this waiver shall remain in effect for the duration of participation in canopy piloting competition and shall survive the conclusion of the activity. Participant’s obligations under this waiver shall continue beyond the date of signature.

10. INFORMATION ACCURACY

Participant warrants that all information provided in this document is true, accurate, and complete. Participant understands that inaccurate information may affect their safety and that of others, and agrees to accept full responsibility for any consequences resulting from inaccurate or incomplete information.
